The Patenting Process


Should you decide that a patent is right for you, there are several options for getting a patent, including filing a utility patent application outright, or filing a provisional application first.

Provisional Patent Application
Utility Patent Application
A Provisional Patent Application (PPA) includes a description of your invention and a drawing. Although a PPA is filed with the USPTO, it is never made public, and it expires after one year. A PPA allows you to claim patent pending and it sets a priority date for filing of a regular (non-provisional) patent application.
A utility As defined by the US PTO, a Utility Patent is "a property right granted by the Government of the United States of America to an inventor to exclude others from making, using, offering for sale, or selling the invention throughout the United States or importing the invention into the United States for a limited time in exchange for public disclosure of the invention when the patent is granted."
